46. PUBLIC QUESTION TIME
Members of the public asked the following questions :
Mr E Holden asked the Chairman in making the decision concerning the communication mast in Newchurch will the committee please take special note of the following :
(a) Section 4.1 of the Stewart Report states that special attention should be given to siting a base station near to a school.
(b) In 1998, the High Court in Newport, Wales handed down a judgement that until firm evidence was available confirming that emissions from base stations were not harmful, genuinely held fear and concern that a health risk may exist was sufficient to provide a refusal to site a base station in sensitive areas.
The Chairman replied that this item would be covered later in the meeting.
47. DECLARATIONS OF INTEREST

The Chairman agreed to an item of urgent business as a decision was needed before the next meeting.
TCP/19448C - Repair and Redecoration of Listed Building (Circular 18/84 Application), Osborne House, East Cowes
Members considered the report of the Director of Environment Services relating to the colour treatment of the external walls at Osborne House, East Cowes.
The views of the Council's Conservation Officer together with the written comments of English Heritage regarding the colour proposed to be used on the exterior of the property were noted.
RESOLVED :
THAT the Conservation Officer be instructed to advise English Heritage that the colour (B) selected is satisfactory and to record member dissatisfaction that the external fabric of the building had been allowed to seriously deteriorate in recent years.
49. REPORT OF THE DIRECTOR OF ENVIRONMENT SERVICES
(a) Review of Present Delegation System for Determination of Planning Applications and Other Planning Related Matters
The Committee was advised that a review of the present delegation arrangements from the Planning Committee to the Director of Environment Services was needed. This would ensure that a more efficient system for determining planning applications and other related matters could be developed and brought into operation at the earliest possible date. The review gave due regard to the quality/speed of the service, present workload, modern trends/advice notes, the views of the District Auditor and the requirements of Best Value. All members of the Council, Town/Parish Councils, principal consultees and local agents would be notified of the new arrangements.
RESOLVED :
(i) THAT the Executive and Council be recommended to agree to the new delegation system for dealing with planning applications and other related submissions with a commencement date of 7 September 2000 be agreed.
(ii) THAT the delegated arrangements in respect of other planning matters, as amended by more recent reports, and other legal related matters, similarly amended, continue in accordance with the scheme originally developed by the Environmental and Planning Services Committee in January 1995, as reported to the Annual meeting of the Full Council in April 2000 be agreed.
(b) TCP/19876/H - Building to Form Bonded Store, Tasting/Meeting Room, Sales Area and Winery Ashey Vineyard, Ashey Road, Ryde, Isle of Wight, PO33 4BB
Members were reminded that they had considered the above application at the Planning Committee meeting held on 11 July 2000. At that meeting members deferred consideration of the application to allow opportunity for further negotiations with a view to incorporate a redesign to ensure the new property did not give the appearance of residential accommodation.
Members were told that the applicant wished the application to be determined as originally submitted.
RESOLVED :
THAT the application be approved subject to conditions.
(c) LBC/10361E - Listed Building Consent for Single Storey Extension to Form Lounge, Fort Norris, Millfield Avenue, East Cowes
(Mr A J Mundy declared a non pecuniary interest in this item and left the room).
Members were reminded that the application for listed building consent had been to the Planning Committee held on 11 July 2000. At that meeting the application was approved further to no comments being received by 14 July 2000 which would warrant reconsideration.
A letter of comment had been received from East Cowes Town Council but members believed there was no sustainable objection to the application.

THAT the application be approved subject to conditions.
(d) Schedule of Appeals
The Schedule of Appeals that had been lodged and decisions made was received.

Firstly, the removal of the spoil and the sections of pipe installed into the ditch with a time period for compliance of seven days; secondly, that the gap in the hedgerow is replanted with a balanced mixture of native species, field maple, privet, dogwood, hawthorn and blackthorn undertaken between 1 November 2000 and 28 February 2001. The hedgerow is to be replanted as a triple row at 0.5 metre centre with the plant size to be whips protected by spiral tree guards supported by canes. Any plants that die within the first two years after planting shall be replaced with new stock of similar species. After planting the new hedge, is to be protected for at least two years by a 1.5 metre high post and wire fence. THAT no action be taken at this time but the situation be monitored.
59. TCP/17965 - Unauthorised tipping of waste material at Brookfield Willows, Ventnor Road, Whitwell
Members considered taking enforcement action with regard to the removal of all the waste material which had been tipped without planning permission at Brookfield Willows, Ventnor Road, Whitwell.
RESOLVED :
THAT an Enforcement Notice be issued requiring the removal of all the waste material which has been tipped without planning permission at Brookfield Willows, Whitwell. Time period for compliance, three months.
60. TCP/21713B - Planning application for use as property as marina staff accommodation, at 5 Bittern Place, Mill Lane, Binfield, Newport
Members gave consideration to amending the Resolution taken by the Planning and Countryside Committee on 7 March 2000 and reaffirmed on 9 May 2000 to take into account Counsel's advice.
RESOLVED :
THAT the resolution be deferred so that consultations may be undertaken.
61. TCP/7084K - Old Somerfield Store, 19-20 High Street, Ryde - Amendments to approved plans
Members considered a request to amend an extant permission, in particular the floor plan layout in terms of the proposed subdivision into two units and the elevations to the High Street and Town Square.
RESOLVED :
THAT the revised drawings 847/234 and 847/20A be treated as amendments to the planning permission granted on 19 November 1997 under reference no. TCP/7084K/P1298/97.

Members gave consideration as to whether the advert was acceptable or whether to instigate prosecution proceedings.

Mrs Jarman raised the issue of waste being tipped at Foxes Path/Perowne Way, Sandown adjoining the former chalet site.
The Chairman replied that further investigations would be undertaken.
